The Sandiganbayan has denied Cagayan de Oro City Mayor Oscar Moreno’s motion to file a demurrer to evidence as well as that of his co-respondents, former bids and awards committee (BAC) members Rolando Pacuribot and Cancio Nicanor Guibone. This is in relation to the alleged anomalous contracts involving the lease of heavy equipment during Moreno’s term as governor of Misamis Oriental from 2007 to 2012.

In a resolution promulgated yesterday, November 22, 2021 and signed by Associate Justice Oscar C. Herrera Jr., the Sandiganbayan Second Division disagreed with the respondents’ contend that the evidence by the prosecution are weak or insufficient to prove their guilt of the crimes charges beyond a reasonable doubt.

The said resolution also stated “...the Court finds the evidence adduced by the prosecution, testimonial and documentary, are prima facie sufficient to sustain the conviction of the accused of the crimes charged, unless successfully rebutted by defense evidence…
