The Supreme Court has disbarred a lawyer from Cagayan de Oro after finding him guilty of gross misconduct in violation of the Code of Professional Responsibility. Atty. Elmer A. Dela Rosa’s name will also be stricken out from the Roll of Attorneys.

In a press release dated November 14, 2019, the SC’s order on the disbarment of Dela Rosa stemmed from a case involving the Palalan CARP Farmers Multi-Purpose Cooperative which hired his services in 1997 in a civil case in the annulment of a Transfer Certificate of Title over a 111.4-hectare land situated in Barangay Lumbia, Cagayan de Oro City, in the Cooperative’s name. In 2002, the Cooperative executed a special power of attorney (SPA) authorizing him to do certain acts but revoked the same in 2007. Despite the revocation of the SPA, Atty. Dela Rosa still brokered the sale of the property.

The decision was promulgated on August 14, 2019. Here’s a screenshot of the decision page.

The decision was unanimously signed by all 14 Justices.
