Mayors and barangay captains not complying with the provisions set forth under Republic Act No. 9003 or the Ecological Solid Waste Management Act in their localities are set to face charges which could lead to suspension or even removal from office. This was disclosed by Department of the Interior and Local Government (DILG) Undersecretary Martin Diño who said the report could be out this month before they start filing cases against the said local officials.
Section 50 of RA 9003 clearly states that local government officials shall be charged administratively if found not complying with or not enforcing rules and regulations of the said law. Also, Section 52 also sets provisions for Citizen Suits against any person including public officials for not performing duties as prescribed under RA 9003. See below.
Among the provisions of RA 9003 include Mandatory Segregation of Wastes and Establishment of Materials Recovery Facility, among others.
