The Sandiganbayan Second Division has denied the two Omnibus Motions filed by Engr. Rolando M. Pacuribot relative to the graft cases in connection with the alleged anomalous equipment lease contracts in December 2011 and falsification of public documents in another equipment rental contract in November 2011, respectively, when he was still Assistant Provincial Engineer of Misamis Oriental.

In a seven-page resolution penned by Justice Oscar C. Herrera, Jr. and promulgated last July 31, 2018, the anti-graft court found no merit in Pacuribot’s Omnibus Motion (with Urgent Prayer to Defer Arraignment) dated May 7, 2018 citing that “all the averments in the information were sufficient” and “contain all the elements which constitute a violation of Section 3(e) of RA  3019″ or the Anti-Graft and Corrupt Practices Act.

The Sandiganbayan likewise denied Pacuribot’s Supplemental Omnibus Motion (with Urgent Prayer to Defer Arraignment) dated May 12, 2018, citing that “all the averments in the information were sufficient” and “contain all the elements of falsification of documents under Article 171, paragraph 2 of the Revised Penal Code”.
