The Sandiganbayan Fourth Division recently convicted former Cagayan de Oro City Councilor President D. Elipe and his sister Pristine Elipe Quizon due to falsification of public documents.

In a 15-page decision dated July 6, 2018 penned by Associate Justice Reynaldo P. Cruz, both respondents were found guilty beyond reasonable doubt for violation of Section 3 (e) of RA 3019 or the Anti-Graft and Corrupt Practices Act and were sentenced from six to ten years imprisonment.

In a related case, both respondents were also found guilty beyond reasonable doubt for the crime of Falsification of Public Document under paragraph 4 of Article 171 of Revised Penal Code and were sentenced from six to eight years imprisonment and perpetual disqualification of holding any public office. The case stemmed from a complaint filed by then City Administrator Dionnie Gersana against the respondents regarding the approval of then City Councilor President Elipe of the Daily Time Record (DTR) of Pristine E. Quizon for the period October 6-31, 2013 despite the fact that Quizon was out of the country on October 25, 29 and 30. The City Administrator’s Office was then conducting an investigation on reports that several City Hall employees were still being paid their salaries despite not reporting for work.

Records revealed that in 2013, Quizon who was then working as Secretary of then City Councilor Elipe accomplished her DTR for the period October 6-31, 2013 and the same was signed by Elipe resulting to Quizon receiving her salary for that period. However, records from the Bureau of Immigration revealed Quizon left the country on October 25 and returned on October 30, 2013. This discovery led to the filing of the case.

In its decision, the Sandiganbayan quashed the defense’ argument of flexi-time due to the absence of the approved copy of the flexi-time request.
